TERMS OF SERVICE
1. INTRODUCTION
Epitapphia is an independent fashion brand operating in accordance with the laws of Ukraine. These Terms of Service govern your access to and use of our website, as well as any purchases made through it.
By accessing the website, browsing our collections, or placing an order, you acknowledge that you have carefully read, understood, and agreed to be bound by these Terms. You confirm that you are legally capable of entering into a binding agreement and that you accept responsibility for complying with all provisions set forth herein. If you do not agree with any part of these Terms, you should refrain from using the website or purchasing our products.

2. BRAND & PRODUCT CHARACTER
Epitapphia creates limited garments, original designs, and made-to-order pieces developed with attention to construction, silhouette, and material integrity. Our collections are not mass-produced and reflect independent production processes and controlled release quantities.
Due to the nature of small-scale and individual production, slight variations in tone, texture, detailing, or finishing may occur. Measurements may include minor tolerances inherent to garment manufacturing, and certain pieces are produced individually after an order is placed. These characteristics are natural attributes of the production process and shall not be considered defects.
We reserve the right to update product descriptions, materials, pricing, or availability at any time without prior notice.
3. MADE-TO-ORDER & CUSTOM PRODUCTION
Certain products are manufactured specifically after an order has been placed. Custom or made-to-order items include garments produced according to selected size, requested modification, or individual production cycle.
Because such pieces are created individually and often initiated specifically for the customer, they are non-refundable, non-exchangeable, and cannot be canceled once production has commenced. Production is considered commenced once materials have been allocated or construction has begun.
An exception applies only in the event of a verified manufacturing defect. By completing checkout, you expressly acknowledge and agree to these conditions.
4. ORDER CONFIRMATION & ACCEPTANCE
Placing an order constitutes an offer to purchase a product. An order is considered accepted only after successful payment authorization and the issuance of a confirmation email by Epitapphia.
We reserve the right, at our sole discretion, to decline or cancel any order, limit purchase quantities, correct pricing or technical errors, or refuse transactions suspected of fraud, misuse, or violation of these Terms. If an order is canceled after payment has been processed, a full refund will be issued through the original payment method.
5. PRICING & PAYMENT
All prices are displayed in the currency indicated at checkout and are subject to change without prior notice. Payments are securely processed through certified third-party payment providers, including WayForPay (Pay by mono). Epitapphia does not store or retain full payment card details.
All transactions are subject to payment provider authorization, verification, and fraud prevention procedures. You are responsible for ensuring that the payment information provided is accurate and that sufficient funds are available for the transaction.
6. PRODUCTION & DELIVERY
Production time is up to five business days unless otherwise specified on the product page. Delivery timelines vary depending on the shipping carrier and destination country, and any estimated delivery dates are provided for convenience only and are not guaranteed.
Customers are responsible for providing accurate and complete shipping details and for covering any applicable customs duties, taxes, or import charges required by the destination country. Epitapphia shall not be liable for delays resulting from shipping carriers, customs procedures, force majeure events, or any other circumstances beyond our reasonable control.
If a shipment is returned due to incorrect address details, refusal of delivery, or failure to collect, reshipment will require additional payment.
7. RETURNS FOR STANDARD ITEMS
For customers located in Ukraine, non-custom items may be returned within fourteen days from the date of delivery, provided the item has not been worn or used, remains in original condition, and includes all original tags and packaging. Items that show signs of wear, alteration, washing, or damage not caused by manufacturing defects will not be accepted.
Return shipping costs are borne by the customer. Refunds are processed within fourteen days after receipt and inspection of returned goods and will be issued through the original payment method.
International returns are accepted under the same conditions, with shipping and customs-related expenses covered by the buyer.
8. DEFECTS & CLAIMS
If an item arrives damaged, defective, or incorrect, you must contact help@epitapphia.com within forty-eight hours of delivery and provide clear photographic evidence of the issue. Upon verification, we may offer a replacement, repair, or refund at our discretion. Claims submitted after the notification period may be declined.
9. INTELLECTUAL PROPERTY
All garment designs, visual identity elements, logos, graphics, written content, product imagery, and website materials are the exclusive intellectual property of Epitapphia. Unauthorized reproduction, modification, resale, distribution, or commercial use is strictly prohibited and may result in legal action. Nothing in these Terms grants any license or right to use our intellectual property without prior written consent.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Epitapphia’s total liability shall not exceed the purchase price paid for the product in question. We shall not be liable for indirect, incidental, or consequential damages, loss of profits or revenue, business interruption, or failures caused by third-party service providers.
Your use of the website and purchase of products is undertaken at your own risk, subject to applicable consumer protection laws.
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising from or related to these Terms shall be resolved in accordance with applicable Ukrainian legislation.
